Terms and conditions for the online shop Hatshopping.com of the ANTHEC GmbH & Co. KG

1. Jurisdiction and contracting parties

2. Order process and conclusion of contract

(1) The illustration of the products in our online shop is not legally binding but represents an offer to buy. You have the opportunity to select and order items from our shop pages. Once you have found a product that you would like to order, you can add it to your shopping cart with no obligation to purchase by clicking on the shopping cart icon. You can view the content of your shopping cart and remove products from it at any time. Once you have added all of the items you would like to purchase to your shopping cart, click on the “proceed to checkout” link. Once you have entered your customer data and chosen your payment method, you will be taken to the order page, where you will be able to verify your entries once again. By clicking on the “BUY NOW“ button, you are placing a legally binding order for the items contained in the shopping cart.

(2) The contract of sale comes into existence as soon as we send you an order confirmation by email directly upon receipt of order. The order is deemed to be confirmed if the article is delivered within five days.

(3) The text of the contract will be saved within our internal systems. Our Terms and Conditions can be viewed and printed at any time. The order data and our Terms and Conditions will also be sent to you in text form. For registered customers, the order data will be available in our shop system even after the order has been placed.

(4) You agree to receive invoices in electronic form.

(5) The languages available in which the contract can be concluded are: German, English, Italian, French, Spanish and Dutch.

3. Right to cancel

Instructions on cancellation

You have the right to cancel this contract within 100 days without giving any reason.

The cancellation period will expire after 100 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us (ANTHEC GmbH & Co. KG, Willy-Brandt-Weg 36, 48151 Münster, Germany, support@hatshopping.com, Phone: +49 251 322654254, Fax: +49 251 32265413) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or email). You may use the attached model cancellation form, but it is not obligatory.

The right to cancel does not exist for the following contracts:

- Contracts for the supply of goods that are made to the consumer´s specifications or are clearly personalised.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than 14 days after the day we receive back from you any goods supplied or (if earlier) 14 days after the day you provide evidence that you have returned the goods or if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4. Terms of payment and delivery

(1) The purchase price is due at the time of the order. All prices include VAT and packing.

(2) Shipping costs will be charged additionally and shown separately on the invoice. They depend on the type of dispatch and the country of destination. For shipments outside the EU, extra customs duties and taxes may arise. You will find further information and our shipping table under “shipping information“ in our web shop.

(3) Payment can be made by Amazon Pay, PayPal, credit card or bank transfer. Please note that the availability of payment methods depends on the selected destination country.

• If you have an Amazon account, you can pay by Amazon Pay. Simply login by using your Amazon account login credentials and choose from the payment and delivery information stored in your Amazon account.

• If you choose to pay by PayPal, no additional costs will arise for you. If you use PayPal’s free direct debit or pay with your PayPal credit, the ordered merchandise may be shipped immediately.

• You can pay with the following credit cards: MasterCard, Visa and American Express. After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.

• If you choose to pay by bank transfer, you must transfer the amount due to our bank account within 7 calendar days. In this case, the product remains reserved for 10 days and the order is only cancelled if we have not received payment for it within this time. Once we receive your payment, the product will be immediately sent to you. Our bank details to pay by bank transfer are as folows: Account holder: ANTHEC GmbH & Co. Please include your order number in the payment reference field so that we can correctly match your payment to your order as quickly as possible.

(4) If your payment is overdue, we are entitled to charge default interest of at least 5% p.a. above the respective base rate. The right to claim any additional damages remains unaffected.

5. Warranty

Warranty obligations are subject to legal provisions.

6. Retention of title

Delivered items remain our property until payment in full has been received.

7. Applicable law

German law applies to the exclusion of the CISG. This does only apply to customers as far as protection provided by mandatory legal provisions in the country in which the consumer usually resides will not be revoked.

8. Privacy

We are committed to respecting and protecting your personal data. They will be used exclusively within the framework of the statutory provisions. For further details see our Privacy Policy.

9. Final provisions

If a provision of these terms is or becomes null or void, this does not affect the validity of the other provisions. Invalid provisions shall be replaced by the relevant statutory provisions.
